1. General statement

Swiss Perfection is specialized in the manufacture and distribution of high-end cosmetics and beauty products. We attach great importance to the security and privacy of your personal data. This Privacy Notice describes the categories of personal data we collect about you, how we may use it, the persons with whom we may share it and how you can exercise your rights in relation to the processing of this information, as well as your rights regarding the use we make of it. It also describes the measures we take to protect the security of personal data, how long we keep it and how you can contact us.

We recommend that you read this Privacy Notice carefully, as it contains important information about your personal data. If you have any questions, you can contact us using the information below in the "Contact Us" section.

2. What personal data do we collect ?

We may collect personal data directly from you (e.g. when you purchase a product in a shop) or indirectly (e.g. from your electronic devices that interact with our websites).

If you choose to provide data to us that relates to other individuals as well (for example when you place an order for someone else or if you involve someone in communication with us), we expect this data to be accurate and that you act within your rights when sharing. We ask you to inform these individuals about our data processing.

For businesses, we process less personal data because data protection legislation applies only to data of individuals. However, we process data of the individuals with whom we are in contact, e.g., name, contact details, professional details and details from communication, and details about management persons, etc. as part of the general information about companies with which we cooperate.

You are not obliged to provide data to us, except in some cases such as when it is required to comply with a contractual obligation. However, we must process data for legal and other reasons when we conclude and execute contracts. The use of our website would also not be possible without some data processing.

2.1 The personal data you provide directly to us:

We process the personal data you provide us with when you register/create a customer account on our websites, during the order and purchase process, when you use the contact form or other form(s) on our websites, when you subscribe to our Newsletter, when you use our digital platforms or when you otherwise communicate with us. The personal data that you share with us or that we collect from you includes the following:

  • First name and surname;
  • Email address;
  • Date of birth;
  • Phone number;
  • Postal address;
  • Credit card payment information when making a purchase on our site;
  • Your PayPal account email address if you have used this service when making a purchase on our site;
  • Where required by law, a tax identifier/identity document number, in order to comply with legal requirements for invoicing.

2.2 Personal data that you provide to us indirectly

We also collect information about your visits to our websites, traffic data, location data, web logs, your IP address through cookies placed on your device. Some cookies are necessary for the proper functioning of our Digital Platforms and others are used for analytical purposes that help provide you with more personalized services and a better digital experience. 3. How do we use your personal data?

We use the personal data we collect in order to register you as a customer, accept purchases, deliver products, engage in customer communication, improve our services, carry out marketing, maintain data security, detect fraud and other misuses, comply with applicable law, and safeguard our legitimate interests. These purposes include the following processing:

  • Optimize certain features or displays of our websites;
  • Improve your browsing experience on our media;
  • Enable the sale of products;
  • Communicate with you and manage our relationship with you;
  • Propose contests and loyalty programs;
  • Carry out audience analysis or statistics;
  • Send you our newsletter, if you decide to receive it. In addition to your name and email address, we also process information about which services you have used, whether you open newsletters and which links you click on. You can object by setting your email program accordingly (e.g. by switching off automatic loading of images);
  • Verify your identity and protect you and us against fraud and other illegal activities, unauthorized transactions, claims and other liabilities, and manage data risk exposure;
  • Maintain and improve the quality and security of our products and services;
  • Comply with our legal and regulatory obligations;
  • Offer you the information or products that best suit you and that may be of interest to you. This is only if you have previously consented to receive such information from us;
  • Optimize your customer experience by monitoring the quality of our offers and services.

Where required in view of an agreement, we may obtain further data from public registers (e.g. the commercial register), the media and the internet.

Please note that if you have a problem with an order or with the interaction on our websites, we may use your personal data to contact you through one of our subsidiaries, which may be better able to respond to your request.

If you apply for a job with us, we process the relevant data to review and assess your application and, for successful applications, enter into an employment agreement. In addition to your contact and communiaction data, we process data contained in your application documents such as your CV, and additional data that we may collect from job-related social networks, the internet, and from references (with your consent).

4. Legal basis for the processing of personal data

Depending on the applicable law, data may only be processed based on legal grounds. This doesn’t apply under the Swiss law, but under the European General Data Protection Regulation (GDPR), where it applies to our processing (which is a matter of individual circumstances). In this case, our processing is based on that it is necessary to enter into and to conclude agreements (article 6(1)(b) GDPR), to safeguard legitimate interests of us or third parties (such as in optimizing our websites, improve our products and services and your browsing experience, proposing contests and loyalty programs, carrying out audience analysis or statistics, fraud prevention, quality and security improvements, or complying with Swiss law; article 6(1)(f) GDPR), to enforce and defend rights (articles 6(1)(f) and 9(2)(f) GDPR), to comply with applicable EU laws (article 6(1)(c) and 9(2)(g) GDPR), or your separate consent (articles 6(1)(a) and 9(2)(a) GDPR).

5. Is your data shared with third parties?

We do not sell or disclose your personal data, except as described here or at the time of collection.

  • We may share personal data with our parent company in South Korea. For example, we procure IT and consultancy service from our parent, and may share your personal data for this purpose. 
  • We use services from outside service providers, especially IT services (examples are providers of hosting or data analysis services), shipping and logistics services and services from banks, the post office, consultants, etc.
  • We may also disclose personal information about you
    • The staff of our stores and of Spa partners, in order to serve you in the best possible way,
    • if we are required or permitted to do so by applicable law or legal process,
    • to judicial and other authorities and other parties participating in legal proceedings in order to comply with a legitimate legal request and if it is necessary to enforce or defend legal claims;
    • as part of an investigation into alleged fraud or illegal activity,
    • if there is a justifiable reason, such as an overriding private or public interest,
    • other persons where we sell or acquire businesses, parts of businesses, assets or companies, or enter into partnerships,
    • in other cases with your consent.

6. Where is your data stored and is it transferred?

The recipients of data are not all located in Switzerland, in particular our parent company in South Korea and certain service providers (especially in IT). These providers may have locations within the EU or the EEA, but potentially also in any country worldwide. We may also share data with authorities abroad if we are legally compelled to do so or, for example in relation with a sale of assets or with legal proceedings (see sec. 5). Not all these countries have adequate data protection. We therefore use appropriate safeguards, in particular the EU standard contractual clauses, which can be found here. In certain cases, we may share data abroad without such safeguards, as permitted under applicable data protection law, e.g., with your consent or where the disclosure is necessary for the performance of the contract, for the establishment, exercise, or enforcement of legal claims or for overriding public interests.

7. How long do we keep your data?

To the extent permitted by applicable law, we will keep the personal data we obtain about you for as long as

  • is necessary for the purposes for which they have been obtained, in accordance with the provisions of this Privacy Notice, or
  • we have another legal basis, indicated in this Privacy Notice (sec. 4), to maintain such data beyond the period during which it is necessary to achieve the initial purpose of obtaining the personal data.

You can exercise your right to have your personal data deleted at any time, see the sections "What are your rights" and "Contact us".

8. What are your rights?

Subject to exceptions and restrictions under applicable law, you may

  • ask to access, modify, update and correct the personal data we hold about you through your Customer Account Board or by contacting us through the contact information below; and
  • ask us to remove or restrict your personal information through our online contact form or by contacting us via the contact information below.
  • Where permitted by law, you may at any time withdraw your consent to the processing of your personal data for legitimate reasons related to your particular circumstances, and we will apply your preferences where appropriate.
  • With respect to the Newsletter, you may choose not to receive it any longer by withdrawing your consent on the Dashboard of your customer account. If you do not have one, a link to unsubscribe is available on the Newsletter. If you continue to receive the newsletter despite your wish not to receive it any more, please contact us.

To protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the information. Depending on your geographical location, you may be able to file a complaint with the relevant national data protection authority (e.g. the Federal Data Protection and Information Commissioner in the case of Switzerland) if you are not satisfied with our response.

9. How do we protect your data?

We have implemented appropriate safeguards in accordance with legal requirements and the state of the art at every stage of the processing of personal data. These measures are designed to protect against the destruction, loss, alteration, unauthorized access, use or disclosure of the personal information you provide to us. Our websites use a variety of appropriate technical security measures, communication protocols and organizational measures. Authentication tools are encrypted to ensure the security of your personal data.

We draw your attention to the need to maintain the confidentiality of the password you established when you registered on one of our websites, which allows you to access certain parts of the site. The protection and confidentiality of your personal data depends on this. Also be aware that the transmission of data via the internet is not completely secure, and we cannot guarantee the security of data transmitted to us by e-mail or through our website.

10. Changes to our privacy policy

This Privacy Policy is not part of an agreement with you and may be updated without prior notice in order to adapt our practices to the legal requirements of data protection or in case of changes in our business activity.
